Police accuse three men of aggravated DWI

Three motorists have been charged with aggravated driving while intoxicated

■ Matthew A. Miraglia, 24, Potsdam, was charged Saturday after being stopped on Leroy Street, Potsdam village police said. He registered a 0.22 percent blood alcohol content. He also was charged with failure to keep right and unlawful possession of marijuana.

A BAC level of 0.08 percent or more is considered proof of intoxication under state law. Aggravated DWI, which carries harsher penalties, is charged when the BAC is 0.18 percent or more.

■ Eric S. Vaikness, 39, of 47 Merritt Lane, Newburgh, was charged Sunday after being stopped on County Route 4 in the town of Oswegatchie, state police said. He also was charged with failure to keep right, having an open container of alcohol and crossing over hazard markings. He registered a 0.21 percent BAC, police said.

■ Kyle W. Maine, 26, Waterville, was charged by state park police after a traffic stop at 3:20 a.m. Sunday on Route 12 in the town of Alexandria. He also was charged with third-degree aggravated unlicensed operation of a motor vehicle and two counts of speeding. His BAC was reported as 0.18 percent. His speeds were cited as 79 mph in a 55-mph speed zone and 80 mph in a 45-mph zone, police said.

The following motorists are charged with DWI:

■ David R. Rocha, 48, County Route 77, Adams, also is cited with failure to keep right after being involved in an accident on Marble Street in Watertown at 2:50 p.m. Sunday, according to Watertown police. He was eastbound and failed to negotiate a curve, causing his pickup to hit the driver-side front fender of a westbound car driven by Tracy J. Disco, 35, Gifford Street Road, police said. He had a breath test result of 0.12 percent BAC, police said.

■ Sean W. Bradke, 53, Potsdam, was charged Sunday after being stopped on Main Street, Potsdam village police said. He also was charged with making an improper right turn. He recorded a 0.17 percent BAC.

■ Michael C. Elliott, 40, of 380 Bishop Road, Heuvelton, was charged Sunday after being stopped on Mitchell Road in the town of Macomb, state police said. He also was charged with unlawful possession of marijuana, consumption of alcohol in a motor vehicle and failure to keep right. He registered a 0.12 percent BAC, police said.
