Wife of man killed in crash of motorcycle files lawsuit

CANTON — The wife of a 28-year-old man killed while riding his motorcycle in May 2007 has filed suit against others involved in the accident.

The wrongful-death lawsuit was brought by Jessica L. Hayes, on behalf of Travis T. Hayes, seeking unspecified damages against Norwood resident Marshall J. Emburey.

Mr. Hayes was riding a motorcycle May 6, 2007, when he was seriously injured in a two-vehicle accident on Route 56 in the town of Potsdam. He died of his injuries four days later.

Mr. Hayes was riding his motorcycle south at 12:22 p.m. on Route 56 near Dry Bridge Road when he hit the back of an all-terrain-vehicle trailer being towed by a truck driven by Mr. Emburey.

Mr. Emburey, driving north, was making a left-hand turn into his driveway when the crash occurred.

The lawsuit was filed Wednesday in the St. Lawrence County clerk's office by John J. Muldowney of the Fischer, Bessette, Muldowney & Hunter law firm in Malone.
