Police accuse five of drunken driving

A man injured in an accident the night of Sept. 22 in the town of Rutland was charged with driving while intoxicated Sunday as a result of the accident investigation, according to the Jefferson County Sheriff's Department.

Randy T. Smith, 21, of 29603 Burnup Road, Black River, also is cited with failure to keep right and a seat belt infraction, deputies said. He was ejected from his car when the accident occurred on Burnup Road, deputies said. A blood sample was drawn for determination of his alcohol level.

The following also were charged with driving while intoxicated and related offenses:

■ Christopher L. Litalien, 43, Schoharie, faces charges of felony aggravated DWI and speeding at 70 mph in a 55-mph zone, lodged at 7:35 p.m. Sunday by Jefferson County sheriff's deputies on Route 177 in the town of Adams. Deputies said he had a breath test reading of 0.28 percent blood alcohol content. Under state law, 0.08 percent BAC is the threshold for intoxication. Aggravated DWI is charged when the BAC is 0.18 percent or more. He is charged with a felony because he was convicted of DWI in July 2008 in Cobleskill, according to the sheriff's office.

■ Joshua J. Sullivan, 25, Jay Street, Ogdensburg, was charged by state police with aggravated DWI at 2:45 a.m. Sunday on Route 37 in Oswegatchie. He also was charged with failing to stop at a red light. Police said he registered 0.24 percent BAC.

■ Wade P. Burr, 22, of 29 Spruce St., Malone, was charged Sunday with aggravated DWI after he was stopped on Porter Road in Malone, state police said. His BAC was 0.19 percent, they said.

■ Dean J. McIntosh, 29, of 5 Mill St., Gouverneur, was charged Sunday with felony DWI, speeding and leaving the scene of a property damage accident after he crashed a car on Trout Lake Road in the town of Hermon, St. Lawrence County sheriff's deputies said. His BAC wasn't available.

Charged with driving while ability impaired by drugs:

■ David A. Blumenthal, 20, Monroe, also was charged by Potsdam police with having inadequate headlights at 8:40 p.m. Saturday on Main Street. Police did not disclose the type of drug he allegedly had taken.

■ Allen E. Marsh, 55, Potsdam, also was charged at 9:25 p.m. Saturday on County Route 59 in the town of Potsdam with unlawful possession of marijuana. State police said he was pulled over for not wearing his seat belt.
