LOWVILLE — The appointed District 1 legislator apparently has been elected to a two-year term, despite losing a Republican primary in September.

Legislator Philip C. Hathway, R-Harrisville, unofficially leads Harrisville businessman Gary L. Williams — running on Republican, Conservative and independent lines — by a vote of 357-312 in Tuesday's general election.

Mr. Hathway, who in April was appointed to fill the seat of the late L. Kelley Dickinson, ran solely on the Independence Party line after being beaten by Mr. Williams, 93-83, in a Republican primary.

The number of possible absentee ballots in Lewis County races was not available Tuesday night.

In District 6, Legislator Joyce E. Hoch, R-Watson, holds a narrow 308-305 lead over Democratic challenger Paul M. Stanford.

Mr. Stanford, who operates a catering business and a used-car dealership, finished second to Mrs. Hoch in a three-way race in 2007.

In District 10, Legislator Jerry H. King, R-West Leyden, easily defeated independent challenger John A. Healt by a vote of 422-194.

Results from two other legislative races — districts 4 and 8 — are being held up by voting machine problems in the towns of West Turin and New Bremen.

Due to a software issue, the counters in the vote scanners at those two town polling sites did not provide an accurate number of voters, County Manager David H. Pendergast said. Those ballots will be counted as soon as today, but the impounding of machines in the 23rd Congressional District potentially could hold that up, he said.

In District 8, fourth-year Legislator Richard C. Lucas, R-Barnes Corners, is challenged by Joseph L. Baruth Sr.

And the District 4 race between Legislator John O. Boyd, D-New Bremen, and Republican challenger Thomas J. Schantz will be decided by the New Bremen votes.

Several Lewis County towns also had contested races:

■ Croghan — Democrat Andrew A. Lehman defeated Republican David C. Zehr by a vote of 415-306 in the supervisor race. Republican Councilman Bernard "Chip" Monnat and Republican John A. Farney earned council seats with 485 and 448 votes, respectively, while Independence Party candidate Allen Merrill received 360 votes.

■ Lyonsdale — Independent challenger Samuel A. Marmon leads Republican Supervisor Roscoe J. Fawcett Jr. by a 173-163 vote. Democrat Matthew J. Farr leads a three-way highway superintendent race with 167 votes, followed by Theodore Mooney with 156 and Charles A. Kraeger Jr. with 27. Republican challenger William L. Marmon and Republican Councilwoman Nancy O'Brien-Dailey lead the council race with 227 and 179 votes, respectively.

■ Montague — Democratic Supervisor Jan Bogdanowicz defeated independent candidate Scott Shattuck, 24-13. Republican Highway Superintendent Adrian F. Perry defeated independent candidate Sidney J. Goutermout, 26-14.

■ Osceola — Republican J. Hugh Quinn defeated Supervisor Julie Painter, running solely on an independent line, by a 72-53 vote. Republican Randy Reynolds defeated independent candidate James Ayott for highway superintendent by an 86-41 vote. And Democratic Councilman Francis N. Yerdon and Republican Keith Munz were the two top vote-getters in the council race with 67 and 58 votes, respectively, followed by Independence Party candidate Amy E. Kornberger with 57 and Republican Amanda L. Sterling with 49.

■ Diana — Republican candidates James A. Durkish and Joseph "Chuck" Langs have earned council seats with 339 and 321 votes, respectively.

■ Lowville — Republican Councilmen Paul R. Virkler and Ruth I. Laribee apparently have been re-elected with 742 and 534 votes, respectively.
