Four admit to DWI in Lewis County

LOWVILLE — Four men pleaded guilty Friday in Lewis County Court to drunken-driving charges.

Clayton T. Fleming,32, of 30880 County Route 143, Felts Mills, was arraigned on a charge of felony driving while intoxicated and pleaded guilty to the charge. He then was admitted into the county's Drug Court program. Mr. Fleming was stopped Aug. 22 on Deer River Road in the town of Denmark.

Ronald V. Herzig II,34, of 27997 Cramer Road, South Rutland, pleaded guilty to felony DWI, also satisfying charges of failure to keep right and having an inadequate brake light. He also was admitted to the Drug Court program. Mr. Herzig was stopped Dec. 28 on Route 126 in the town of New Bremen.

Harvey G. Williams,52, of 4165 Lyons Falls Road, Lyons Falls, was arraigned on a felony DWI charge and pleaded guilty to that charge. He was placed on interim probation, with sentencing set for Nov. 5, 2010.

Brian R. VanDusen,26, of 18555 County Route 69, Adams, pleaded guilty to felony DWI. Sentencing was set for Jan. 22. He was stopped May 7 on Route 12 in the town of Denmark.

Also in Lewis County Court on Friday:

Dave A. Gibeau,51, of 23831 Hickey Road, Carthage, was sentenced to five years' probation, six months of house arrest, $3,000 in fines, a one-year driver's license revocation, mandatory attendance at a victim's impact panel in December and $420 in court fees on charges of felony DWI and first-degree aggravated unlicensed operation of a motor vehicle. Mr. Gibeau on Aug. 28 entered Alford pleas on those charges, meaning he accepted the pleas without admitting he committed a crime. He was stopped Jan. 23 on Factory Road in the town of Diana.

Shane D. Henry,19, of 9939 Route 12, Copenhagen, pleaded guilty to second-degree rape, also satisfying a charge of endangering the welfare of a child. Sentencing was set for Dec. 18. He was charged with having sexual relations with a girl younger than 15 years old in April 2008 in the town of Denmark.

Jeannette E. Parker,22, of 9768 Main St., Croghan, was sentenced to three years' probation, $880 restitution and $200 in court fees on a charge of fourth-degree criminal mischief, to which she pleaded guilty. Ms. Parker was accused of shoving Sade D. Emerson and damaging his 32-inch television March 22 in the town of Croghan.

Royal D. Nuffer,49, of 10101 Third Road, Castorland, had his case of first-degree criminal contempt and fourth-degree stalking adjourned to Jan. 22. He is accused of continually walking or driving past the town of Croghan home of his estranged wife, Amy S. Nuffer, between March and October, and violating an order of protection issued on her behalf.

Hannah E. Gaut,21, Cincinnati, Ohio, had her case of fifth-degree criminal possession of a controlled substance, driving while intoxicated and speeding adjourned to Jan. 22. Ms. Gaut was stopped Sept. 6 on Route 26 in the town of Turin during the moe.down music festival. She also was accused of possessing Ecstasy pills.
