Westernville man sentenced to year in jail for felony DWI

LOWVILLE — An Oneida County man was sentenced Friday in Lewis County Court to one year in county jail on a drunken-driving charge.

Robert F. DeHart,42, Westernville, also was sentenced to $1,208.75 restitution, a $250 fine and a one-year driver's license revocation on charges of felony driving while intoxicated and leaving the scene of a property-damage accident, to which he pleaded guilty Oct. 23.

Mr. DeHart was charged July 26 on Odett Road in the town of Greig after damaging property at the Kathy Rubar residence.

Also on Friday in Lewis County Court:

William J. Denslow Jr.,30, of 6823 McAlpine St., Lyons Falls, was sentenced to five days in county jail, three years' probation, a $1,000 fine and a one-year driver's license revocation on a charge of misdemeanor aggravated DWI, to which he pleaded guilty Sept. 11. Mr. Denslow was stopped Feb. 28 on Route 12 in the town of Turin.

Ronald P. Bacon,41, of 8198 Soft Maple Road, Croghan, following successful completion of the county's Drug Court program, was sentenced to five years' probation, a $2,000 fine and a one-year driver's license revocation on a charge of felony DWI, to which he pleaded guilty in November 2008. Mr. Bacon was charged after he drove his all-terrain vehicle into the back of another machine July 19, 2008, on French Road in the town of Martinsburg.

Robin M. Zwart,55, Utica, had his third-degree grand larceny case dismissed by Judge Charles C. Merrell, because Mr. Zwart already had served more than 200 days in county jail while awaiting a possible trial next month. He had been charged with collecting $9,921.36 in public assistance benefits through the Lewis County Department of Social Services to which he was not entitled between Nov. 6 and 29, 2006.

Brian M. DeHart,29, 6090 Main St., Greig, was arraigned on two counts each of first-degree burglary and second-degree assault and single counts of fourth-degree criminal mischief and endangering the welfare of a child. He pleaded innocent, and his case was adjourned to Dec. 4. Mr. DeHart was accused of hitting his estranged wife, Kylie, in the face with a marble ball and destroying property Sept. 5 at her town of Martinsburg residence. The alleged incident occurred in front of children.

Mark A. Westbrooks,27, of 704B Phelan Drive, had sentencing on a charge of first-degree rape adjourned to Dec. 4. A jury on Sept. 30 found Westbrooks guilty of the charge. He was accused of raping a woman Jan. 31 in the town of Denmark.

Hiram J. Jimenez,55, Syracuse, had his case of first-degree aggravated unlicensed operation of a motor vehicle and speeding adjourned to Dec. 18. He was stopped May 9 on Route 3 in the town of Diana.
