POTSDAM — A Potsdam man was charged Friday with allegedly downloading and having child pornography after police reportedly found about 300 pornographic images and videos.
David L. LaBrake, 40, was charged with felony possessing a sexual performance by a child, village police said. He was arraigned in Village Court and released under probation supervision.
He had been charged in May by federal authorities with possessing and distributing child pornography.
A plea agreement worked out by state and federal prosecutors last month states that LaBrake will plead guilty in St. Lawrence County Court, Canton, to felony possessing a sexual performance by a child, federal court records show. His guilty plea will satisfy federal charges. No sentencing date has been set in County Court.
The plea calls for him to serve 11/3 to four years in state prison and register as a sex offender when released, according to the court. He was accused of having about 250 images and 55 videos of child pornography on his computer.
