Croghan man sentenced to prison term on attempted-assault charge

LOWVILLE — A Croghan man was sentenced Friday in Lewis County Court to state prison time on an assault charge.

Gary D. Genito Jr., 31, of 10025 Erie Canal Road, was sentenced as a second felony offender to 1½ to 3 years in prison and $1,436 restitution on a charge of second-degree attempted assault, to which he pleaded guilty Nov. 18.

He was accused of attempting to assault Keith Seeley on March 5 at Club Central in Glenfield.

Mr. Genito’s accomplice, Douglas A. Bender, 32, of 36851 Route 26, Carthage, had sentencing on a third-degree assault charge adjourned to Feb. 10.

Also in Lewis County Court on Friday:

Brandon R. Dicesare, 23, Port Charlotte, Fla., was sentenced to two years in state prison, three years of post-release parole supervision and $216 restitution on charges of second-degree assault and endangering the welfare of a child, to which he pleaded guilty Jan. 20. Judge Charles C. Merrell also issued an eight-year order of protection on the victim’s behalf. Mr. Dicesare was accused of punching a 16-year-old boy in the head June 21 in the town of Lyonsdale.

Isaac W. Russell, 32, of 9768 Route 812, was sentenced to six months in county jail, five years’ probation, $176 restitution and a six-month driver’s license revocation on charges of fourth-degree criminal sale of a controlled substance and fifth-degree criminal possession of a controlled substance, to which he pleaded guilty Oct. 21. Mr. Russell was accused of selling Vicodin and Adderall in the village of Croghan.

James R. Sullivan, 33, of 3503 Route 12, Port Leyden, was sentenced to five years’ probation on a charge of aggravated criminal contempt, to which he pleaded guilty Dec. 9. Judge Merrell also issued an eight-year order of protection on the victim’s behalf. Mr. Sullivan was accused of assaulting a boy under the age of 17 on Sept. 22 in the town of Leyden.

Maketa Rodgers, 63, of 8165 Number Four Road, Lowville, pleaded guilty to charges of driving while intoxicated and third-degree aggravated unlicensed operation of a motor vehicle. Sentencing was set for March 23.

Matthew A. Rebb, 25, Route 3, Natural Bridge, was arraigned on charges of felony DWI, first-degree aggravated unlicensed operation of a motor vehicle and operating a vehicle without an ignition interlock device and pleaded guilty to those charges. He subsequently was entered into the county’s Drug Court program.

Kriss A. Whitney, 45, Steam Mill Road, Harrisville, had his case of two counts of second-degree criminal mischief and single counts of third-degree burglary, second-degree reckless endangerment and third- and fourth-degree grand larceny adjourned to Feb. 17.

Mr. Whitney was accused March 24 of stealing a 2001 Chevrolet pickup truck owned by Thomas Chartrand and repeatedly driving it into the Trackside Tavern on Depot Street in Harrisville, as well as into a 2000 Dodge Dakota being driven by Thomas Manchester on Depot Street. Damage was listed at $12,315.05 to the bar’s door, window, porch and various interior items and at $6,300 to the stolen truck.

Mr. Whitney also faces various charges in St. Lawrence County stemming from a police chase there.

James A. Curtis, 46, Dover-Foxcroft, Maine, had his case of second-degree criminal possession of a forged instrument adjourned to March 2. Mr. Curtis was accused of attempting to fill a prescription containing an altered date Oct. 22, 2010, in Lowville.
