CANTON A Gouverneur woman filed a lawsuit Tuesday in state Supreme Court accusing a Carthage restaurant of recklessly serving a patron too much alcohol.
The patron, Bobbie Jo Mona-ghan, 42, Watertown, caused a vehicle accident that resulted in the death of Kathleen Deyo.
Ms. Deyos sister, Kelly A. Peck, is bringing the six-page lawsuit against Herrings Inn.
The lawsuit accuses the restaurant of unlawfully serving unreasonable amounts of alcohol. The employees should have known Ms. Monaghan intended to operate a vehicle and a potentially dangerous situation existed, the lawsuit specified.
Alcohol-serving policies needed to be in place to prevent the accident, according to the lawsuit. The employees conduct caused the accident, the lawsuit alleged.
Ms. Peck, represented by James Reid of Syracuse, is asking for an unspecified money amount for emotional trauma.
Ms. Monaghan was sentenced June 21 in Jefferson County Court to 12⁄3 to 5 years in state prison for pleading guilty to first-degree vehicular manslaughter and first-degree vehicular assault for the crash on Jan. 14, 2010.
