LOWVILLE Lewis County has filed suit against Timberview Resort for nonpayment of nearly $7,500 in bed tax payments.
The state Supreme Court suit, filed by Assistant County Attorney Keith A. Lyndaker last week, claims the Houseville restaurant and motel owes $7,470 in hotel occupancy tax stemming back to September 2010 and an additional $1,033.28 in interest and penalties. The resort, corporately based in Yonkers, has historically failed and refused to comply with the countys 5 percent tax on lodging and only recently provided quarterly receipts without the requisite payments for several past pay periods, the suit states.
Bruce R. Krug, a former Democratic legislator and chairman from Leyden, in April expressed concern that the county might not be vigorously pursuing collection of the tax after receiving a list of delinquent businesses through a court-ordered Freedom of Information request.
