JCC requests dismissal of age discrimination lawsuit

Jefferson Community College has asked a federal judge to dismiss an age discrimination lawsuit a former administrator filed.

Gail W. Miller, 68, of Chau-mont, the college’s former director of college outreach, filed a lawsuit May 22 in U.S. District Court, Syracuse, against the college, its board of trustees, Jefferson County, college President Carole A. McCoy and Sarah H. Baldwin, the college’s former vice president of administration, alleging her job was eliminated in 2010 in retaliation for her complaint to the trustees about age discrimination.

In a response filed Thursday, the college denied the claims and countered any alleged damages “were caused by plaintiff’s culpable conduct.” The college contends that if any damages are awarded in the matter, they should be reduced accordingly.

Buffalo-area attorney James H. Cosgriff III filed the response on the college’s behalf.
