WEST LEYDEN A town of Ava man was arrested Sunday on an attempted murder charge for allegedly shooting another man.
State police additionally charged Albert B. Nellenbach, 35, of 11641 Webster Hill Road, with first-degree assault. He was arraigned in Floyd Town Court and sent to Oneida County jail, Utica, on $50,000 cash bail or $100,000 bond.
Mr. Nellenbach was accused of shooting Jesse P. Wilcox, 31, Boonville, in the earlobe, elbow and back with a .22-caliber rifle. Mr. Wilcox was taken to Upstate Medical University, Syracuse, were he initially was listed in stable condition.
Police said that at about 6 a.m. Sunday, Mr. Wilcox, along with his wife, Christy L. Wilcox, 26, and stepfather, Lester Platt, 50, went to the Nellenbach Webster Hill Road residence to look for Mr. Wilcoxs brother, Jared Platt, an acquaintance of Mr. Nellenbach. The trio looked around the outside of the house, then left without going to the door but later returned to the house and saw Mr. Nellenbach in a sleeping bag along the tree line on the property, according to police.
As they walked toward him, he suddenly jumped up and started shooting at them, police said.
An investigation into the incident is continuing.
