Jefferson County Legislator James A. Nabywaniec, R-Calcium, was charged with driving while intoxicated Thursday evening in the town of LeRay.

Mr. Nabywaniec, 47, of 25183 Route 11, Calcium, was charged by state police at 11:03 p.m. Thursday on Route 11 in the town of LeRay. His blood alcohol content was 0.13 percent, troopers said. The state’s legal limit is 0.08 percent.

State police said he was observed stopped on the west shoulder of the road when a trooper stopped to talk to him. He was ordered to appear in LeRay Town Court.

Mr. Nabywaniec, a legislator since 2004 who is the chairman of the Board of Legislators Health and Human Services Committee, released the following statement Saturday;

“On Thursday evening, I went out to dinner with my brother and his family who are visiting from out of town. While driving home, I was ticketed for DWI. As always I take full responsibility for my actions, I will work through the process and put this matter behind me.”
