MALONE - A Brushton man has been sentenced to state prison for a burglary conviction by Franklin County Court Judge Robert G. Main Jr.

Jeremy Russell, 30, of Brushton was sentenced by Judge Main in Integrated Domestic Violence Court to two years in state prison, followed by three-years post-release supervision for attempted second-degree burglary. He was also fined $2,500.

According to Assistant District Attorney Gary Pasqua, Russell admitted Sept. 20 that he broke into his ex-girlfriend’s house late at night while she slept on Oct. 16, 2011. She was not injured, according to Mr. Pasqua, but there was an order of protection in place.

“They had a long-term relationship as well as a child in common, and I believe there was alcohol involved,” Mr. Pasqua said, adding that there was no indication of what Russell’s intentions for breaking into the house.

A May 24 grand jury indictment had charged Russell with second-degree burglary and first-degree criminal contempt.
