State police allege that a woman was driving while intoxicated with three children as passengers at 7:20 p.m. Nov. 1, when her car struck a utility pole along County Route 67 in the town of Watertown.

The arrest of Kjerstin L. Krohn, 36, of 17951 North VanAllen Road, on charges of felony aggravated driving while intoxicated and endangering the welfare of a child was disclosed Wednesday by state police.

She and one of her passengers, an 11-year-old girl, were taken to Samaritan Medical Center for treatment, police said.

Two other children, a 7-year-old girl and 5-year-old boy, were not taken to the hospital, police said.

Driving while intoxicated with a child passenger is a felony under Leandra’s Law. Mrs. Krohn’s blood alcohol content would have been determined with a blood test at the hospital.

State police arrested him at 3:45 p.m. Monday on Route 3 in the town of LeRay. Police said he had a breath test reading of 0.24 percent BAC.

A BAC of 0.08 percent or more is considered proof of intoxication under state law. Aggravated DWI is charged when the BAC is 0.18 percent or more.
