Hammond man indicted on homicide charge in Theresa crash

A Hammond man has been indicted on allegations that he was driving recklessly when he caused an accident in October that killed a Redwood woman and injured her companion.

Mark C. Hujar, 47, of 3167 County Route 6, is charged with criminally negligent homicide, third-degree assault, reckless driving, unsafe passing, driving to the left of pavement markings and speeding. The accident occurred in a no-passing zone, a key element in the allegation that he created a risk of death to other motorists by operating his vehicle negligently.

The charges were contained in a grand jury indictment unsealed Monday in Jefferson County Court.

It is alleged that on Oct. 18, he was traveling above the posted 55-mph speed limit on Route 37 in the town of Theresa when he attempted to pass an uninvolved vehicle without leaving enough room to safely avoid an oncoming car operated by Michael W. Homan, Redwood. The vehicles collided, and a passenger in the Homan vehicle, Robin T. Broughan, 53, was killed.

Mr. Hujar also was charged with assault because Mr. Homan suffered multiple broken bones, an abdominal injury and a cut to his scalp in the crash.

Mr. Hujar pleaded not guilty to the charges at arraignment Monday and was released on his own recognizance by Judge Kim H. Martusewicz, as Mr. Hujar has been showing up for all of his court appearances leading up to the unsealing of the indictment.
