St. Lawrence County grand jury indicts three in forgery, DWI cases

CANTON — An Ogdensburg man has been indicted by a St. Lawrence County grand jury after he allegedly gave police false information last month while being questioned in connection with an assault case.

Marcus F. Smith, 40, of 215 Lafayette St., Apt. B, was indicted Monday on charges of second-degree forgery and false personation.

According to Ogdensburg police, Mr. Smith gave the name “Marc Collins” when questioned March 3. He later signed the same name, as well as providing an incorrect address and date of birth, police said.

Also indicted by the grand jury:

Courtney J. Errigo, 36, of Summerville, S.C., was indicted on five counts of aggravated driving while intoxicated and two counts of DWI after allegedly crashing her vehicle July 2 in the town of Norfolk with her two young daughters as passengers.

Indictment documents indicate that tests showed Ms. Errigo’s blood alcohol content was 0.29 following the crash. A BAC of 0.08 percent or more is considered proof of intoxication under state law.

Aggravated DWI is charged when the BAC is 0.18 percent or more.

State police said Ms. Errigo’s daughters, then ages 3 and 5, were not in child restraints at the time of the crash. They were taken to Massena Memorial Hospital for evaluation, but were not injured, troopers said. Ms. Errigo suffered minor left arm injuries.

Joseph G. France, 38, of 442 Cousintown Road, Apt. 1, Canton, was indicted on two counts of DWI in connection with an Oct. 31, 2011, incident on County Route 21 in the town of Canton. Indictment documents indicate that tests showed Mr. France’s BAC was 0.14 percent.

He previously was convicted of felony DWI in 2007 and misdemeanor DWI in 2009, according to the indictment.
