The Appellate Division of the state Supreme Court ruled Thursday that the mother of slain EMT Mark B. Davis is entitled to death benefits, upholding a 2011 decision by the state Workers Compensation Board.
Mr. Daviss mother, Marsha L. Dickinson, had been granted benefits on Sept. 22, 2011, but Jefferson County appealed the compensation boards decision.
According to documents filed Thursday with the Appellate Divisions Third Judicial Department, justices agreed Mr. Davis was the primary breadwinner for the family and the family was significantly affected when his financial contributions ceased at the time of his death.
Mr. Davis was shot and killed by Christopher G. Burke while responding to a call in Cape Vincent on Jan. 30, 2009. Mr. Burke was sentenced in 2011 to 16 years in prison.
