ARREST WARRANT - MASSENA - Norfolk-based state police picked up Howard J. Malone, 37, of 431 Grantville Road, Norfolk, on Thursday on an arrest warrant issued by Massena Village Justice Eric J. Gustafson on May 20.

He was turned over to Massena Village Police and arraigned by Massena Justice Gerald P. Sharlow. Malone was released on his own recognizance and a temporary no contact order was issued directing Malone to have no contact with Justin Barney.

Malone was charged with a misdemeanor count of third-degree assault stemming from an incident that occurred at about 2 a.m. April 6. He allegedly struck Mr. Barney with his fist, causing physical injury while inside the Delmar Tavern.

One witness told police Barney was standing near the bathroom door when the incident occurred. “I heard some pops on the bathroom door. He was putting his shoulder into the door. The door popped open,” Zachary Kunh told polic.

“He went into the bathroom. Howard Malone was trying to exit the bathroom, and Justin was holding the door with his foot. Howard pushed Justin one time, and Justin fell. He hit his head on the floor. He (Howard) then went back into the bathroom,” Mr. Kuhn said, noting he had uttered a threat to an apparently knocked out Mr. Barney before he went back into the bathrrom.

Mr. Kuhn said Mr. Barney was knocked out for about 3 minutes. He said he took Mr. Barney home, alerted his wife to her husband’s injuries and then drive him to the hospital.

NO SEATBELT - MASSENA - Village police ticketed Danny K. Kelly, 60, of Plumbrook Road, Norfolk, for failure to wear a seatbelt following a traffic stop at 8:40 p.m. Thursday on Main Street.

NO SEATBELT - MASSENA - Village police ticketed Cory J. Cry, 23, of West Main Street, Massena, foir failure to wear a seatbelt following a traffic stop at 5:57 p.m. Thursday on Park Avenue.
