MASSENA - A Massena man convicted of threatening his then-estranged wife’s father with a kitchen knife during an incident on the morning of Oct. 27 has been resentenced to serve 45 days in the St. Lawrence County Correctional Facility.

Acting Massena Village Justice James M. Crandall had fined Ronald J. Joubert, 21, of 183 Wallace Road, Norfolk, $400 and a $205 surcharge for a second-degree attempted menacing conviction on Dec. 19. He was also placed under a one-year conditional discharge and ordered to pay a $50 fee and provide a DNA sample.

Mr. Crandall ruled Joubert had violated an order of protection when he was charged with second-degree harassment and endangering the welfare of a child following an incident April 19 in the Price Chopper parking lot. Mr. Crandall also sentenced Joubert to a concurrent term of 15 days in the county jail after he pleaded guilty to a second-degree harassment count in a plea bargain agreement to satisfy charges stemming from that incident.

He had been charged with jabbing a large kitchen knife toward Jeffrey C. Kirkey’s stomach and swinging that knife at Mr. Kirkey’s face during a dispute on the morning of Oct. 27. Village police had charged Joubert with second-degree menacing.

Mr. Kirkey told police he went to his daughter’s Franklin Street residence that morning to take her car shopping and received a cool greeting from his daughter’s estranged husband, who was at the residence and started swearing at him and ordering him to leave the residence.

“He started coming at me quickly with fists clenched by his side. I told him he better make it a good shot because he was going to be arrested,” Mr. Kirkey noted in the statement he signed for police.

“Ronald then grabbed a big knife off the stove and pulled it back as he lunged at my stomach with it. I was able to move out of the way of the knife. Ronald then pulled the knife back again and swung it at my face, but I was able to pull my head back to avoid it,” he added.

Mr. Kirkey said he then left the residence, went to his vehicle and called police. Joubert said he left his residence and had started walking to his friend’s home on Maple Street when he was picked up by police.

In other recent court action before Judge Crandall:

■ Jason T. Page, 42, of 7 Winter St., Massena, was fined $500 and a $205 surcharge after pleading guilty to a prosecutor’s information charging him with a reduced count of fourth-degree criminal possession of a weapon. He was also ordered to pay a $50 fee for submission of a DNA sample to the state’s database.

Village police charged Page with a felony count of third-degree criminal possession of a weapon at 6:15 p.m. Wednesday after they were called to his residence by federal parole officers. They discovered a 7 mm Remington rifle in his vehicle when they were making a home visit Nov. 14.

Page is prohibited from having any weapons as the result of a September 1988 conviction for third-degree attempted burglary. He was placed on federal probation in November 2008 on following his conviction for possession with intent to distribute or dispense marijuana.
