MALONE Franklin County Legislator Guy H. Tim Smith, 71, entered a plea of not guilty Monday in Malone Town Court on a charge of driving while ability impaired by alcohol.
Franklin County Undersheriff Patrick A. White said Mr. Smiths blood alcohol content was 0.055 percent in a roadside test and was 0.050 percent at the police station.
Mr. Smith, who is a Democrat representing Fort Covington, was pulled over about 6 p.m. Aug. 15 a few miles outside the village. A sheriffs deputy said Mr. Smiths vehicle crossed over the center line.
State police assisted with the subsequent field sobriety test, as the Sheriffs Department did not have a Breathalyzer.
Mr. Smith is running unopposed for re-election this fall. He has been a legislator since 2001, and was chairman of the County Legislature from 2006 to 2011. He serves on the Finance and Human Resources committees, and is majority leader on the board.
