Jurors hear tape of alleged drug sales in Watertown

A Jefferson County Court jury on Wednesday heard two audiotapes of alleged drug sales made by a Brooklyn man to a confidential informant working for police.

Keith A. Smith, 35, is on trial for allegedly selling heroin and cocaine from a Huntington Heights apartment and for allegedly possessing the drugs with the intent to sell them. It is alleged that he sold the informant heroin in early September and crack cocaine in early December.

After the alleged December sale, members of the Metro-Jeff Drug Task Force executed a search warrant at Mr. Smith’s apartment and reportedly found 85 envelopes of heroin with an estimated street value of more than $2,500. A small amount of crack cocaine and cash also were seized, according to trial testimony.

The informant testified that Mr. Smith, whom she knew only as “Herc” or “Hercules,” sold her three envelopes of heroin for $60 in September. She also claimed that he sold her $50 worth of crack cocaine in December.

The alleged sales were captured on audiotape, although drugs were not specifically referenced on the tapes.

The informant’s testimony confirmed that she purchased drugs from Mr. Smith and she said she immediately turned the drugs over to members of the task force waiting in nearby vehicles.

The informant testified that the only consideration she received for working with the task force was that a member of the unit agreed not to disclose to the media information about a petit larceny charge brought against her.

The trial is scheduled to enter its third day this morning.
