Kidnapping trial to begin after a bevy of delays


CANTON — After two days of jury selection, the trial of Patrick R. Lloyd and Miranda M. Green, the couple being charged in the assault and attempted kidnapping of a Massena woman, will begin this morning.

Mr. Lloyd, 25, of New York City, and Ms. Green, 18, of 37 Howard St., Massena, are accused of shoving Catherine A. Berry, 18, to the ground and punching and kicking her in the face several times on Feb. 16. Police said they then restrained Ms. Berry’s hands and tried to force her into their vehicle before their actions drew the attention of neighbors in the Sycamore Street area where the incident took place. Ms. Berry reportedly suffered bruises and facial swelling as a result of the attack.

Mr. Lloyd and Ms. Green are both facing charges of second-degree attempted kidnapping, first-degree unlawful imprisonment, second-degree unlawful imprisonment and petit larceny.

Mr. Lloyd is facing an additional charge of second-degree attempted assault and Ms. Green is facing an additional charge of third-degree assault.

Since the original indictment, however, there have been circumstances that have slowed the trial and could cause problems for the prosecution as Ms. Berry recanted her original accusations against the pair in a written statement to Canton private investigator Donald J. Tracy on June 4.

“He did not try to put me in the car. Miranda Green did not make the statement to put me in the car,” Ms. Berry said in the June statement signed in the presence of Mr. Tracy.

Then, on Aug. 27, the trial was adjourned for three weeks and the original panel of potential jurors was dismissed after Ms. Berry, the star witness in the trial, went missing.

She was found two days later in a Franklin County motel by state police in the company of known associates of Mr. Lloyd, namely, her boyfriend, Cody Burke, 21, and Jessica Monahan, 26, both of Massena.

Ms. Berry was placed on probation by St. Lawrence County Judge Jerome J. Richards, was ordered not to have contact with Mr. Burke and Ms. Monahan and was subpoenaed to appear for testimony Sept. 17.

On Sept. 5, however, in a multiagency drug trafficking bust, Mr. Burke and Ms. Monahan were two of the 11 people arrested and Ms. Berry was found in bed with Mr. Burke in the early morning raid by federal, state and county law enforcement officials.

Ms. Berry had been detained by U.S. marshals and will be in court for testimony following opening remarks, which are scheduled to begin at 10:15 a.m.
