DWI - MASSENA - Village police charged Bruce J. Kearns, 38, of 325 East Orvis St., Massena, with driving while intoxicated, unlawful possession of marijuana and fourth-degree criminal mischief at 11:02 p.m. Sunday. Police said the charges stemmed from a complaint when he allegedly went to Crystal L. Moniere’s residence and reportedly damaged her yard with his vehicle before fleeing the scene.

Police said Kearns damaged the side yard and a portion of the front yard before driving across the sidewalk and curb when he left the residence. One witness told police he was concerned Kearns was going to strike the house.

Police said they located Kearns a short time later at the Blue Spruce Motel, and he reportedly had a blood alcohol content of 0.17 percent, more than double the 0.08 level that constitutes a DWI count in New York state. Two witnesses told police Kearns had been driving the truck on Tamarack Street, police said.

They noted they discovered Kearns had a small plastic bag containing marijuana in his pocket when he was being process on the other charges.

He was arraigned by Massena Village Justice Eric J. Gustafson and sent to the St. Lawrence County Correctional Facility with bail set at $500 cash or $1,000 bond.

Moniere had previously been charged with breaking Kearns’s eye socket during an altercation Sept. 19, while Kearns was charged with two misdemeanor counts prior to be shipped to the Vermont Medical Center in Burlington, Vt., for treatment of his injuries following that incident. Kearns was described as Moniere’s boyfriend in the September court documents.

Village police had charged Moniere with third-degree assault. She was released under the supervision of the probation department with a stipulation she abide by a temporary order of protection directing her to stay away from Kearns,.

Kearns was charged with fourth-degree criminal mischief and fourth-degree criminal possession of a weapon.

Police said Kearns took Moniere’s phone during a domestic dispute after she told him she was going to call the police. He also reportedly damaged the phone. Police said when they were investigating the domestic dispute they discovered Kearns, a convicted felon, was in possession of a black powder rifle.

The assault charge alleged Moniere punched Kearns in the eye and nose shortly after 10 p.m. Sept. 19 during an altercation at the couple’s home.

Kearns told police the argument started over a discussion about her kissing one of his friends about a year ago.

She said she responded when Kearns started pushing her, telling police he had grabbed her very hard by the arms.

“The argument ended up going into the bedroom. Bruce and I wrestled around in the bedroom, and Bruce hit me a couple of times. I kept swinging at him. I struck Bruce a few times in the face, I also believe I scratched Bruce on the nose because I saw blood somewhere,” Moniere said in her statement.

“Bruce kept getting more upset. Bruce kept telling me to hit him. Bruce then grabbed my phone when he left because he knew I wanted to call the police,” she added.

Court documents report police indicated Kearns and Moniere both appeared to be under the influence of alcohol at the time of the incident.

INADEQUATE HEADLIGHTS - MASSENA - Village police ticketed Courtney E. Lashomb, 23, of Cook Street, Massena, for operation of a vehicle with no headlights at 9:04 p.m. Sunday following a traffic stop on Parker Avenue.
