Massena traffic stop leads to felony count, DWI charge; passenger charged with heroin possession

MASSENA - Village police charged Nicole M. Devincenzi, 31, of 3524 Oneida St., Chadwicks, was charged with driving while intoxicated and a felony count of first-degree aggravated unlicensed operation of a motor vehicle following a traffic stop at 3:35 a.m. Saturday on Main Street.

Police said the occupants in the vehicle had been involved in a disturbance complaint from the McDonald’s restaurant on South Main Street. She was also ticketed for operation of a vehicle with broken glass.

Devincenzi reportedly had a blood alcohol content of 0.12 percent. She also admitted she had 10 or more suspensions on her license. A blood alcohol content of 0.08 percent or higher constitutes a DWI count.

A passenger in her vehicle was charged with a drug count.

Village police also charged Cassandra L. Remali, 28, of 33 Parkside Ave., Mills, with seventh-degree criminal possession of a controlled substance after four waxed paper baggies containing a substance testing positive for heroin were located in a cigarette package.

They were both held overnight in the village lockup and arraigned Saturday morning before Massena Town Justice Gerald P. Sharlow.

The court, while acknowledging Devincenzi had an attrocious driving record, said the women had no other criminal histories and released them both on their own recognizance.
