MASSENA - A Massena man charged with illegally possessing a Suboxone strip has been sentenced to serve 45 days in the St. Lawrence County Correctional Facility following a guilty plea in Massena Village Court.
Massena Village Justice Eric J. Gustafson also ordered Casey D. McMillan, 25, of 52 Maple St., also listing a Buckton Road, Winthrop, address, to pay a $205 surcharge and a $50 fee to submit a DNA sample to the state database.
Village police had charged McMillan and Keith W. Snyder of 405 South Main St., Massena, with seventh-degree criminal possession of a controlled substance at 2:35 a.m. Feb. 15 following the execution of a search warrant at 405 South Main St.
In other recent court action before Judge Gustafson:
■ Karl J. Baile, 23, of 277 Trippany Road, Massena, pleaded guilty to one count of driving while intoxicated. The court directed the probation department to conduct a pre-sentence investigation and scheduled sentencing for Jan. 28.
Village police had charged Baile with third-degree unauthorized use of a motor vehicle and aggravated driving while intoxicated at 3:31 a.m. March 17 in the Andrews Street parking lot.
Faith Deshane reported to police at 3:11 a.m. that her vehicle, a 2001 Dodge Caravan, had been stolen from the McDonalds parking lot, South Main Street. The vehicle was located a short time later in the parking lot behind the Delmar, and Baile was in the vehicle next to it. He reportedly dropped a second set of keys when he exited the vehicle.
He later acknowledged he had gone to McDonalds earlier with some girls he did know. Deshane told police Baile was the only person left in her vehicle when she went into McDonalds. He had a blood alcohol content of 0.21 percent. A DWI is elevated to aggravated DWI when the blood alcohol content is 0.18 percent of higher.
■ Brendon J. OHiggins, 57, of 221 East Orvis St., Massena, was fined $500 and a $260 surcharge for a driving while ability impaired conviction. His operating privileges were suspended for 90 days.
Massena-based state police had charged OHiggins with driving while ability impaired by drugs and ticketed him for failure to keep right, failure to signal a turn and making an improper left turn following an incident at 2:10 a.m. April 13 on Bayley Road in Massena.
Troopers said when they questioned OHiggins during the traffic stop he didnt know what street he was on and said he said taken some prescribed tranquilizers earlier that night and gone to bed. He said he woke up and went to the store to purchase cigarettes.
■ Patrick H. Bulger, 24, of 8 Prospect Ave., Massena, was fined $500 and a $260 surcharge for a driving while ability impaired conviction. His operating privileges were suspended for 90 days.
Bulger had been charged with driving while intoxicated at 10:32 p.m. Aug. 28 following a traffic stop on Bayley Road. Police said they were responding to a complaint that a vehicle fitting the description of the vehicle Bulger was operating had attempted to drive onto the railroad tracks off Curtis Avenue. He had a blood alcohol content of 0.12 percent. A blood alcohol content of 0.08 percent or higher is proof of intoxication in New York state.
■ Joseph H. Boisvert, 32, of 52 Beach St., Massena, was fined $500 and a $260 surcharge for a driving while ability impaired conviction. His operating privileges were suspended for 90 days.
Boisvert had been charged with driving while intoxicated following a traffic stop at 2:50 a.m. April 29 on Bishop Avenue in the village of Massena. He was also ticketed for making an illegal signal less than 100 feet from the turn and operation of an unregistered motor vehicle. He had a blood alcohol content of 0.10 percent.
