AGGRAVATED DWI - POTSDAM - St. Lawrence County Sheriff’s Department deputies charged Aaron T. Capone, 36, of Route 56, Hannawa Falls, with felony counts of driving while intoxicated, first-degree aggravated unlicensed operation of a motor vehicle, second-degree forgery and first-degree offering a false instrument for filing and a misdemeanor charge of second-degree criminal impersonation Capone had also been ticketed him for operation of a vehicle with inadequate plate lights following a traffic stop early Saturday morning on state Route 56 in the town of Potsdam. He reportedly had a blood alcohol content of 0.24 percent, three times higher than the 0.08 BAC threshold for a DWI charge. A DWI count is elevated to the more serious offense of aggravated DWI when the blood alcohol content is 0.18 percent of higher. Deputies said Aaron had identified himself as his brother, Jason, during that stop and signed several documents with Jason Capone’s name while he was being processed on the DWI charge. Deputies had issued a press release Saturday morning reporting that Jason Capone, 41, had been charged with aggravated DWI before determining the vehicle had actually been being operated by his brother.
