BENCH WARRANT - MASSENA - Massena-based state police picked up Mitchell Nanticoke, 26, of 4 Snye Road, Akwesasne, on a bench warrant Monday. The warrant had been signed by Massena Town Justice Gerald P. Sharlow on Oct. 25 after Nanticoke failed to appear in court as directed on a pending second-degree criminal contempt count. He was arraigned by Mr. Sharlow and sent to the St. Lawrence County Correctional Facility before being released after posting $500 bail.
Troopershad charged Nanticokewith second-degree criminal contempt at 5:35 p.m. June 12 after he was allegedly found violating an order of protection during a secondary inspection at the U.S. port of entry in Rooseveltown.
Nanticoke was a passenger in a vehicle being operated by Charlene A. Lazore, 26. U.S. Customs and Border Protection officers said during their secondary investigation they discovered an order of protection directing Nanticoke to stay away from Lazore, whom he identified as his girlfriend. That order was signed by Bombay Town Justice Curtis C. Smith on April 3 and directed Nanticoke to have no contact with Ms. Lazore. That order had been signed after Nanticoke was charged with fourth-degree criminal mischief and third-degree menacing.
Following Nanticokes arrest on the criminal contempt count, Mr. Smith modified the order of protection on June 18 from stay away to no harassment.
