Man accused of having child porn at the border had cell phone photos of young teens: Ogdensburg police


Authorities allege a Quebec man had sexually explicit images of young teens on his cell phone when he crossed the border into the U.S. at Ogdensburg Thursday.

Charged with possession of a sexual performance by a child was Kensly R. Guerrier, 27, of Gatineau, Quebec. The images were discovered by U.S. Customs and Border Protection agents during a secondary inspection at the border that included a search of his phone, said Ogdensburg police Detective David M. Layng.

Mr. Layng said the images amounted to “a couple of pictures,” of underaged teens that were sexual in nature.

Customs and Border Protection spokeswoman Shelbe Benson-Fuller would not comment on the reason for the secondary inspection, and said that agents routinely review the information on cell phones and other electronic devices belonging to those seeking entry to the U.S.

“CBP officers are authorized to conduct border searches of electronic devices without requiring a predefined level of suspicion — aligning it with the constitutional authority the department holds to search equally sensitive non-electronic materials, such as notebooks, photo albums and diaries and must adhere to all requirements to protect privileged, personal and business confidential information,” she said in an email message.

The charge is a class E felony.

He was arraigned in City Court and sent to St. Lawrence County jail, Canton, on $10,000 cash bail or $20,000 bail bond. He was still in jail Monday.

Mr. Layng said a preliminary hearing will be scheduled.

He said Mr. Guerrier has dual citizenship in Canada and the U.S.
