A Gilbert, Ariz., man was charged Jan. 17 after he was stopped on Route 11 in the town of LeRay by Jefferson County sheriffs deputies, who reported that he had made an improper right turn and that they found him to be intoxicated.
Christopher A.J. Brown, 23, was transported to the Metro-Jefferson Public Safety Building and administered a breath test that determined his blood alcohol content to be 0.24 percent.
Under state law, a BAC of 0.08 percent or more constitutes proof of intoxication.
Because his BAC was over 0.18 percent, he was charged with aggravated DWI, which, potentially, carries a harsher punishment.
He was processed, turned over to military police and scheduled to appear in Town Court.
