A Watertown man was sentenced Tuesday in Jefferson County Court to 10 years probation for having sexual intercourse with an incapacitated woman in 2102.
Russell E. Martin, 37, also was sentenced to an unspecified amount of time served at the Metro-Jefferson Public Safety Building and ordered to register with the state as a Level 1 sex offender after pleading guilty Nov. 12 to third-degree rape. He admitted that on Aug. 19, 2012, he had intercourse with an 18-year-old woman who was incapable of giving consent due to intoxication.

Casaundra L. Mashaw, 24, of 36599 Route 180, LaFargeville, was sentenced to five years probation and ordered to pay $3,838 in restitution after pleading guilty Dec. 10 to third-degree criminal mischief. She admitted that she intentionally damaged a vehicle belonging to Robert Fitzsimmons on July 13 in the town of Cape Vincent.
Carrie M. Cheers, 27, Beaver Falls, was sentenced to five years probation and fined $1,000 after pleading guilty Dec. 10 to felony driving while intoxicated. She admitted driving while intoxicated Aug. 18 on Route 126 in the town of Watertown. She also was ordered to perform 30 days of community service and install an ignition interlock on any vehicle she owns or operates. Her drivers license was revoked.
Derrick L. Mack, 19, whose last known address was 205 Franklin St., Apt. 206, pleaded guilty to third-degree attempted criminal possession of a controlled substance and trespassing. He admitted that he possessed heroin with the intent to sell the drug Sept. 5 in Watertown. He also admitted entering the apartment of a neighbor who was in jail without the neighbors permission the same day. He is expected to be sentenced March 24 to a year in the PSB.
Linda L. Pitts, 44, of 615 Camp Ave., pleaded guilty to fourth-degree attempted grand larceny. She admitted that between Aug. 6, 2010, and May 31, 2011, she tried to obtain Department of Social Services benefits to which she was not entitled. Police said at the time of her arrest in January 2013 that she had claimed her 24-year-old son resided with her when he actually had moved out. She is expected to be sentenced March 24 to no worse than probation and be ordered to pay restitution.
Shane M. Millard, 33, Sacramento, Calif., pleaded guilty to third-degree attempted criminal possession of a weapon. He admitted that on Jan. 2 he possessed an AR-15 rifle with a flash suppressor, collapsible stock and pistol grip. Sentencing was set for March 24.

Richard B. Spurling, 46, Mexico, was sentenced to a one-year conditional discharge and ordered to complete the Bridge program after pleading guilty Dec. 3 to seventh-degree criminal possession of a controlled substance. Further information about the charge was not available from the court.
Solomon O. Clarke, 20, Brooklyn, pleaded guilty to third-degree attempted criminal possession of a controlled substance. He admitted that he tried to possess cocaine with the intent to sell the drug Oct. 31 in the town of LeRay. He is expected to be sentenced March 14 to two years in prison, followed by two years post-release supervision.
Trudi L. Harney, 45, whose last known address was 520 Gotham St., Apt. 1., pleaded guilty to second-degree criminal contempt. She admitted violating probation by committing the new crime. She admitted that on Oct. 3 she violated an order of protection held by Benjamin M. Kilburn. At the time, she was serving three years probation imposed in County Court in April for a third-degree assault conviction, with Mr. Kilburn being the victim in that incident. She is expected to be sentenced March 31 to six months in the PSB and a new term of three years probation.
Michael D. Yarbrough, 46, whose last known address was 383 Flower Ave. E., Apt. 2, pleaded guilty to second-degree criminal contempt. He admitted that he violated a City Court order of protection by having unwanted physical contact with Cynthia M. Garnsey on Aug. 10 in Watertown. He is expected to be sentenced April 7 to a year in the PSB.
Samantha J. Halko, 22, of 9727 Erie Canal Road, Croghan, pleaded guilty to fourth-degree criminal mischief. She admitted that on Aug. 31 she intentionally damaged a car belonging to Malayna L. Love on State Street. She is expected to be sentenced March 28 to no more than three years probation and be ordered to perform community service and pay $2,151 in restitution.
Michael S. Brancatella, 20, Antwerp, pleaded guilty to third-degree criminal mischief. He admitted that on June 12, 2012, he punctured tires and broke windows on a Toyota Tacoma owned by Nhung H. Nguyen, Watertown, He is expected to be sentenced March 26 to five years probation.
