ASSAULT - CANTON - St. Lawrence County Sheriffs Department deputies charged James O. Upshur, 48, of 59 1/2 Maple St., Apt. 2, Massena, with second-degree assault Thursday following an investigation into an incident at the St. Lawrence County Correctional Facility. Upshur allegedly struck and injured another inmate at the facility. He was arraigned in Canton Town Court and sent back to the county jail with no bail set on the new charge. The court was unable to set bail since Upshur has two prior felony convictions.
Massena Village Police had charged Upshur, and Luke D. Hehir, 22, of 59 Maple St., Apt. 1, Massena, with second-degree burglary and petit larceny at 5:53 p.m. Oct. 20 after responding to a report of a burglary in progress report at 7 Clary St.
Police said the duo were in possession of shower curtain rod rings, an RCA sub woofer, speakers, plastic bags, silverware and one bullet.
Upshur was additionally charged with unlawful possession of marijuana after he was found in possession of one gram of marijuana. Hehir was also charged with possession of burglar tools.
Both men were reportedly carrying bags when witnesses saw them enter the vacant home, and Hehir was found in possession of a flashlight and two screwdrivers.
Police said Hehir also had stolen Playstation paddles in his bag.
Upshur was reportedly in possession of one Remington Magnum 7mm bullet, silverware and dog grooming nail clippers.
The vacant property is owned by Kurt T. Breitbeck, Louisville, who has been renting the property under a land contract agreement to Joseph Woodall, Norfolk. Mr. Woodall was not living in the residence at the time of the burglary.
Upshur had initially been held at the county jail on the burglary count with bail set at $10,000 cash or $20,000 bond. His bail was later revoked after the court determined he had two previous felony convictions.
He was sentenced to serve five to 10 years in state prison for a third-degree criminal sale of a controlled substance conviction on June 6, 1989 in Queens County. He was also convicted of third-degree grand larceny in April 1987 in New York City.
