Heuvelton man sentenced to prison on probation violation


CANTON — A Heuvelton man was sentenced in St. Lawrence County Court on Monday to up to 4 years in prison after violating his probation and being arrested on weapons charges.

Dalton M. Perry, 20, of 4384 County Route 10, Heuvelton, had been sentenced to one year of interim probation on June 4 for fifth-degree criminal sale of a controlled substance for his March 11 sale of oxymorphone in Ogdensburg.

As a part of the court’s commitment to Mr. Perry, if he successfully completed the year of probation, he would have been eligible for youthful offender status, meaning he would not have a criminal record after serving his time and a minimum of 1 year to a maximum of four years in state prison.

In court Monday, County Judge Jerome J. Richards said he was no longer bound by his commitment to Mr. Perry after he failed to comply with the terms and conditions of that sentence when he was arrested in October on felony third-degree criminal possession of a weapon, misdemeanor fourth-degree criminal possession of a weapon and fourth-degree criminal possession of stolen property.

“You also agreed that while you were remanded you would comply with the rules of the jail,” Judge Richards told Mr. Perry. On Jan. 15, Mr. Perry threw caulking at a corrections officer and lied about it, Judge Richards said.

“You still break the rules and you don’t get the big picture,” Judge Richards told Mr. Perry.

Judge Richards vacated Mr. Perry’s probation and sentenced him to a minimum of two years and a maximum of 4. Mr. Perry was also denied his opportunity at youthful offender status and is ordered to pay $125 in court fines, fees and surcharges.
