Black River village Zoning Board to consult legal counsel on property variance


BLACK RIVER — The village Zoning Board of Appeals at its Jan. 30 meeting adjourned a public hearing on an area variance in order to consult legal counsel.

Adam Brown requested the variance to divide his property at 187 Maple St. into two properties. Since the road frontage is 132 feet, the division would create two lots with 66 feet along the road. Village code requires 100 feet of road frontage.

Code enforcement officer David M. Lachenauer said questions arose that he could not answer, so the matter was held over to consult with Village Attorney Mark G. Gebo.

In question was whether two variances were required, one for each new lot, and concerns about the existing house on the property. Built in the 1800s, the house was already on a nonconforming lot and the question arose whether the situation should be grandfathered.

The hearing on the issue will continue at the next meeting.
