Woman sues Walmart over fallen object


MALONE — A Burke resident is suing the Walmart Supercenter after an item fell off an upper shelf in the store and hit her in the head.

Sandra L. Smith filed a complaint this month stating she “sustained serious personal injury” when the object hit her and caused her head to “jerk backwards” and make “a ‘cracking’ sound.”

The court document states that Walmart is culpable for the incident after “maintaining a dangerous display on items for sale without proper safeguard for the patrons,” along with failing to secure potentially hazardous displays, warn patrons of danger, adequately inspect the display or have sufficient personnel to ensure stability and security of items on a display.

Ms. Smith claims she was required to undergo “extensive medical treatment” and endured “substantial pain and suffering.” The incident caused her to lose time from work and hence lose income.

The complaint demands judgment against Walmart of an unnamed amount. Court documents do not specify what the object was.

“Although we have not received the complaint in this case and can’t comment specifically on the allegations, Walmart is strongly committed to providing a safe shopping experience,” Betsy Harden, a Walmart media relations specialist, said. “Our commitment includes having policies and practices regarding the safe display of merchandise, as well as other aspects of customer and associate safety.”

The original incident occurred in March 2011, according to court documents.
