WATERTOWN — An ex-convict faces a possible return to state prison after being charged with selling heroin in an indictment unsealed Monday in Jefferson County Court.

Amanda L. Serrano, 31, of 165 E. Division St., faces two counts each of third-degree criminal sale of a controlled substance and third-degree criminal possession of a controlled substance. It is alleged that she had and sold heroin on April 17 and again on April 21.

Mrs. Serrano is participating in Drug Court, having been referred to the program that is designed to serve as an alternative to incarceration in June 2012 after pleading guilty to third-degree criminal sale of a controlled substance, heroin. If she were to successfully complete Drug Court, her conviction would be amended to fifth-degree criminal sale of a controlled substance and she would face a sentence of five years’ probation.

However, if it is determined that she violated her Drug Court contract, she faces a five-year prison sentence, followed by three additional years of supervision upon her release. Mrs. Serrano has served two prior prison sentences, most recently a two- to four-year term imposed in County Court in January 2009 for fourth-degree criminal possession of stolen property and a Drug Court violation.

In February, she was featured in a two-part report on WWNY TV-7 depicting her struggles with heroin use. Judge Kim H. Martusewicz ordered her held without bail Monday at the Metro-Jefferson Public Safety Building on the alleged Drug Court violation.
