Stephen W. Burke, a Macomb Democrat running for his partys nomination in the race for New Yorks 21st Congressional District, is filing a new action in his effort to stay on the ballot for the June 24 primary.
Last week, the state Board of Elections invalidated Mr. Burkes petitions for having an insufficient amount of signatures.
Mr. Burke appealed the boards decision today. He said the judge reviewing the case asked him to file a new action to respond to the boards decision and that he expected another ruling fairly quickly.
The original challenge was brought by Jason R. Clark, a St. Lawrence County Democrat.
