CONSTABLE State police on Wednesday charged Joseph R. McMahon, 22, of 29 Elm St., Massena, with driving while intoxicated.
Troopers said that at 9:10 p.m. during a traffic stop on Route 122, Mr. McMahon was found to be under the influence of alcohol and had a blood alcohol content of 0.11 percent. Under state law, a BAC of 0.08 percent or more constitutes proof of intoxication.
Mr. McMahon also was charged with first-degree aggravated unlicensed operation, a Class E felony, due to a revocation of his license for a previous driving while ability impaired conviction, troopers said. He also was cited with inadequate exhaust and driving an uninspected motor vehicle.
He was arraigned in Burke Town Court and released under probation supervision.
