PIERREPONT — State police on Sunday charged John R. Hess, 64, Potsdam, with aggravated unlicensed operation, driving while intoxicated, previous conviction in 10 years, and driving while ability impaired by drugs, previous conviction in 10 years, all felonies.
Troopers allege that at 12:27 p.m. on Route 56 in the town of Pierrepont, Mr. Hess was driving north at 45 miles per hour in a 30 mile-per-hour zone. During a traffic stop, it was determined that Mr. Hess was under the influence of alcohol following a failed sobriety test and had a blood alcohol content of 0.16 percent, troopers said. Under state law, a BAC of 0.08 percent or higher constitutes proof of intoxication.
Troopers said the DWAI by drugs charge was based on Mr. Hess telling them he was on pain medication.
He was arraigned in Town Court and released under probation supervision.
