FOWLER — State police on Sunday charged Ian T. Martin, 17, Gouverneur, with aggravated contempt for allegedly violating an order of protection and aggravated driving while intoxicated, first offense, under Leandra’s Law because he allegedly had a child in the vehicle, both felonies.
Troopers allege that at 8:34 p.m. on Smith Road in the town of Fowler, Mr. Martin was driving northbound with Jessica R. Brown, 23, also of Gouverneur, and a 15-year-old male at an unsafe speed, causing the vehicle to go through a curve, exit the east shoulder, strike a tree and overturn.
Troopers said Mr. Martin’s blood alcohol content was not available because he would not comply with either a breath test or a blood test at Gouverneur Hospital, where the three occupants were treated for minor bruises and released.
Upon further investigation, troopers said Mr. Martin had a no-contact order of protection against him in favor of the 15-year-old passenger.
Mr. Martin was arraigned in Town Court and released under probation supervision.
