Winthrop man sent to jail for violating probation in attempted-rape case


CANTON — A Winthrop man convicted of attempted rape in December was sent to jail Tuesday for six months for violating his probation.

Kyle E. Simon, 20, of 9463 Route 11, Winthrop, formerly of Brasher Falls, also was sentenced to an additional 10 years of probation by St. Lawrence County Judge Jerome J. Richards for multiple violations of his one year of interim probation. He was taken to the St. Lawrence County Correctional Facility.

Simon plead guilty Oct. 15 to a reduced count of second-degree attempted rape, a class E felony, in a deal reached with the district attorney’s office. On Nov. 21, 2012, Simon, then 18, had sexual intercourse with a 15-year-old girl. He had been indicted by a St. Lawrence County grand jury on charges of second-degree rape and endangering the welfare of a child for allegedly giving the female marijuana.

According to reports received by the court from the probation department, Simon had been drinking and tested positive for alcohol consumption, failed to report to probation on multiple occasions, left the state without permission from the probation department and failed to complete sex offender treatment.

Judge Richards denied granting Simon youthful offender status, which would have cleared the charge from Simon’s record after he served his sentence.

In addition to jail time and probation, Simon was ordered to pay court fines, fees and surcharges totaling $1,475.

Judge Richards scheduled a sex offender registration hearing in October for Simon.
