Brasher Falls man, already incarcerated, sentenced to one-year conditional discharge


MASSENA - A Brasher Falls man charged with damaging a door during a domestic dispute with his girlfriend in March was placed under a one-year conditional discharge and ordered to pay $355 in fines, surcharges and fees after pleading guilty to a reduced count in Massena Village Court.

Village police had charged Kyle A. Griffin, 28, of 163 Hopson Road, Brasher Falls, with second-degree harassment, fourth-degree criminal mischief and fourth-degree criminal mischief - preventing an emergency phone call March 18 following a domestic dispute at 118 Maple St. He reportedly pushed Leslie Robinson and broke the glass in the back door during a dispute over money, police said.

Griffin pleaded guilty to one count of fourth-degree criminal mischief in a plea bargain agreement that satisfied the other charges pending from the incident.

Massena Village Justice Eric J. Gustafson fined Griffin $100 and a $205 surcharge and ordered him to pay a $50 fee to submit a sample of his DNA to the state database.

St. Lawrence County Assistant Conflict Defender Heather Dona said Griffin is currently serving a nine-month sentence in the county jail after admitting he had violated the conditions of his probationary sentence stemming from a conviction in St. Lawrence County Court.

In other recent court action before Judge Gustafson:

• Eric J. Deshane, 20, of 733 County Route 37, Massena, was sent back to the county jail after pleading not guilty to a second-degree criminal contempt count pending in village court, He is also being held at the St. Lawrence County Correctional Facility without bail by county court .

• Evan D. Delosh, 27, of 2 Perkins Road, formerly of 60 Liberty Ave., Massena, was ordered to pay a $205 surcharge and a $50 fee to submit a sample of his DNA to the state database after pleading guilty to possession of a hypodermic needle in a plea bargain agreement that satisfied a second count. He was also sentenced to serve 10 days in jail.

“I think we both know there is no sense in placing you on probation,” Mr. Gustafson said, noting the jail time made more sense for a defendant who had not fared well under probation supervision in the past.

Delosh is currently serving a 90-day jail sentence imposed by Potsdam Town Court after he admitted he had violated the terms of his probationary sentence. The two jail sentences will run consecutively. With credit for good time, he told the court his sentence from the Potsdam Town Court would be completed on Sept. 5.

He had been charged with seventh-degree criminal possession of a controlled substance and illegal possession of a hypodermic needle at 3:33 p.m. July 16 after he was picked up on a warrant on Maple Street.

The warrant, signed in December 2010, alleged Delosh had violated the terms of his probationary sentence for a criminal trespass conviction from Potsdam Town Court. Police said when they took Delosh into custody they found he had a needle drawn to hold suboxone in his pocket. Delosh previously told the court he had a prescription for suboxone.

• Erin M. Abelard, 32, of 14380 state Route 37, Massena, was sent back to the county jail on $250 bail after pleading not guilty to two counts of possession of a hypodermic needle. She allegedly was found in possession of two needles on July 1. She is also being held on an additional $500 bail on charges pending in Norfolk Town Court and Massena Village Court.
